1. The Legality of Personal Data Processing

The basis for the processing of the User's personal data is carried out as long as We have fulfilled one or more of the following processing bases:

1. We have obtained Your consent legally and explicitly;

3. We exercise our authority or fulfill our obligations in accordance with Applicable Law and/or orders from authorized agencies;

1. Types and Details of Information provided by Users

   For a better experience, when using the Services, We may ask You to provide Us with certain information that can be identified as personal data, including but not limited to Your name, address, electronic address (email) information, photo of Yourself or photo ID card, date of birth identification number, telephone number, Taxpayer Identification Number, and bank account. The information that You provide will be stored and used by Us only for the purpose of using the Service, or the Platform and/or making or carrying out a Residential lease and with regard to this Privacy Policy.

2. Types and Details of Information Collected Automatically

   We may collect some information automatically from Your device, including but not limited to device type, Your device's Internet Protocol (IP) address, browser type, login information on the Platform, computer operating system, application version, language settings, and mobile network information. We will use this information to optimize the performance of Our Platform, address technical issues, and improve the overall use of the Services.

3. Purpose of Use and Processing Personal Data

We use and process the User's personal data for the following purposes, among others:

1. Registration or filling in the digital form provided by Us in the context of using Services through the Platform of BVLY;
2. Creation of lease/rental agreements and approval of T&C applicable to the Platform of BVLY;
3. Filling the data on the Platform of BVLY for confirmation purposes, including but not limited to the payment process;
4. Invitation to the User to provide a review of the Residential booked through Platform;
5. Collection of statistical information related to the User’s performance and browsing patterns when accessing Platform;
6. Provide information related to the use of the Platform, including information on Services and promotional materials;
7. Submission of booking details to Our Manager to bill the User, including but not limited to additional fees that have not been settled;
8. Management of access to Resident;
9. We may share User data with Our service staff which allows Us to serve User and answer User questions related to booking of Services that We provide.

4. Sharing and Disclosure of Data with Third Parties

We may use the services of third parties and/or processors of Your personal data, whether within and/or outside Indonesia, to help Us provide and improve Our Services. Such providers will be able to have access to Your personal information, but will be bound by obligations under an agreement or contract with Us to be able to securely manage Your personal data and use it only for the purposes specified by Us. We can only disclose Your personal information to other third parties in the following circumstances:

1. What if required by law or in the context of fulfilling legal obligations (legal compliance) based on Applicable Law;
2. There is an authorized officer warrant or court order;
3. Where required by Our partners to carry out their duties, including but not limited to the fulfillment of rental bookings, processing transaction payments, sending letters/emails/SMS or other communication media, data analysis, assistance services, presentation of search results, improving security and privacy, as well as developing and improving Our Platform;
4. We may transfer all or most of the User's personal data to a third party for the company's benefit, including but not limited to mergers, consolidation, acquisition, or reorganizations that result in a transfer of control or ownership of Us. Such transfer will be notified to the User;
5. In cooperation with business partners or other third parties who provide services for the maintenance, development of the Platform of BVLY, and/or other relevant services, We may provide access to the User’s personal data to such parties;
6. For the purpose of providing a review of the use of Services on BVLY Platform, the User agrees that such data may be displayed on Our Platform, service providers related to Us, or third parties who cooperate with Us; and/or

5. Cookies

Cookies are software that allow the system of the Platform of BVLY to recognize the User as the same user based on information from the computer or mobile device used to access the Platform of BVLY. Such information includes, but is not limited to, IP address, server information, User’s preferences, and Your browsing history on our Platform, and the email address and password used to access Platform. The Cookies file containing such information is stored on the User’s device.

We use Cookies to track activity on Our Services and keep certain information.

You can instruct Your device to reject all Cookies or indicate when Cookies are being sent. If you do not accept Cookies, you may not be able to use some parts of Our Services.

6. Security

We value Your trust in providing User’ personal information to Us and therefore, We will use security measures in accordance with applicable standards to protect Your personal information from any unauthorized actions (including but not limited to unauthorized access, alteration, and disclosure).

However, for the record, no method of transmission over the internet, or method of electronic storage is 100% (one hundred percent) secure and reliable, so We cannot guarantee absolute security to You.

7. Location Data

When You use the BVLY Platform, we may collect location-related information through third party’s Software Development Kit (“SDK”) integrated to the application (such as building access and mapping services). This location data is used solely to enable application functionality, including verifying Your proximity to building access points and displaying relevant facility or services information based on Your Location.

We do not actively track or store Your precise location history. Location permissions may be requested by integrated third party’s SDK and the processing of such data may be carried out by SDK providers in accordance with their respective privacy policies.

Granting location access is voluntary and based on Your consent granted through Your device settings. You can manage, restrict, or revoke location access permissions at any time through your device settings. However, please note that disabling location access may cause some features or services on the Platform to malfunction or become unusable.

8. Link to Other Sites

This Service may contain links to other sites. If you “click” on a third-party link, then you will be redirected to that third-party site. Please note that such external sites are not operated by Us. Therefore, We strongly recommend that you review the Privacy Policy and T&C within this Platform. We have no control over and are not responsible for the content, privacy policies, or practices of any third-party sites or services.

9. Children’s Privacy

Our Platform and/or Services are not intended for individuals under the age of 17 (seventeen). Users who are not yet 17 (seventeen) years old must be represented by a parent or legal guardian. We do not knowingly collect personally identifiable information from children under 17 (seventeen) years of age. If We find that a child under 17 (seventeen) years of age has provided personal information, then We will immediately delete it from Our Platform.

If You are a parent or guardian and You know that Your child has provided personal information to Us, then You can contact Us so that We can take the necessary action.

10. Retention Period of User Personal Data

We may store and use the User’s personal data for up to the period necessary to fulfill the purposes of processing the personal data. In addition, the storage is carried out with reference to the provisions of the Applicable Law.

11. Your Rights as a Personal Data Subject

1. Right to Information and Access to Personal Data

   You have the right to know the identity of the party requesting Your personal data, the purpose for which it is being used, and to obtain access to or a copy of Your personal data through the official BVLY Platform. Requests for copies may be subject to a fee in accordance with Our policy.

2. Right to Rectification and Data Updates

   You have the right to update, complete, and/or correct inaccurate personal data.

3. Data Deletion

   In some circumstances, You may request that Your personal information be deleted and/or destroyed. Please note that if You request deletion of Your personal information, or if Your account is suspended, terminated, or voluntarily closed, We may retain Your personal information for as long as necessary for Our legitimate Service or business interests, such as preventing money laundering, fraud detection and prevention, and enhancing security. Information You have shared with others, such as review information, will continue to be publicly visible on our Platform, even after Your account is canceled or deleted. However, attribution of such information to you will be removed. It is possible that some copies of Your information will remain in Our databases (such as automated information), but this information will be separated from Your personal information.

   Because We may take measures to protect data from accidental or malicious loss or destruction, residual copies of Your personal information may not be removed from our backup systems for a limited period.

4. Withdrawal

   You have the right to withdraw Your consent to the processing of Your personal data that You have given Us.

5. Objection

   You have the right to object to automated processing of Your personal data, including profiling, that has legal consequences or significantly impacts You in accordance with Applicable Law.

   You have the right to exercise other rights related to the processing of Your personal data as regulated by Applicable Law.

You represent and warrant that all data provided, whether in written or otherwise, in the course of using the Service is true to you and has not been obtained from third parties without Your authorized consent. Therefore, any consequences arising in connection with the submission and correctness of such data are Your sole responsibility.

By agreeing to this Privacy Policy, You represent that You have read and understood all of its terms and agree to the contents of this Privacy Policy. In particular, You give Your consent to Us to carry out the collection, processing, analysis, storage, disclosure, correction and deletion of Your personal data in accordance with this Privacy Policy.
